Terms, Conditions, Privacy & Acceptable Use

1.1 Introduction

Welcome to MixelNodes (“MixelNodes”, “we”, “us”, “our”). MixelNodes is a personal hosting project offering Minecraft server hosting, Discord bot hosting, VPS, websites, and related technology services.

By using our services, you accept these Terms of Service (TOS), our Privacy Policy, and our Acceptable Use Policy (AUP). If you do not agree, you should not use the services.

1.2 Nature of the Service

MixelNodes is an independently operated personal project, not a formal commercial enterprise. Services are offered on a limited basis, without permanent commercial availability guarantees.

2.1 Account Registration

To access services, you must provide accurate, complete, and up-to-date information—including full name, valid email, and a payment method. We do not store full financial data. You are responsible for the accuracy of your data and any loss arising from incorrect information or misuse.

2.2 Eligibility & Minimum Age

You must be at least 16 years old or have verifiable consent from a parent or legal guardian. We may suspend or remove accounts of minors without proper authorization, without any obligation to refund.

2.3 Account Security

You are responsible for keeping your password confidential and for all activity under your account. We will never ask for your password by email or direct message. If access is lost, services are not transferred nor refunded except in justified and verified cases.

3.1 Service Activation

Services are activated after full payment is confirmed (currently PayPal or bank transfer). In exceptional cases, we may enable services before payment; this does not create an obligation to deliver or continue.

3.2 Service Suspension & Termination for Non-Payment

Clients are responsible for ensuring the timely payment of all invoices for their services. Invoices must be paid by the due date. Unpaid services are suspended 1 day after the due date. The service and its data will be retained for 20 days while suspended. If payment is not received within those 20 days, the service will be terminated and all data permanently deleted with no recovery.

3.3 Billing

All payments are in advance and in U.S. dollars (USD). If payment is not received within the agreed time, the service may be suspended or deleted without notice, and stored data may be lost.

All resources, hardware, software, infrastructure, and server data are the property of MixelNodes. You obtain a temporary license to use the service, not ownership. Breach of these terms may result in immediate suspension without refund.

4.1 Storage Limits

Resources must be used only for their intended purposes: Minecraft (worlds, plugins, configs, logs); Discord bots (configs, scripts, light databases); VPS or websites (files and apps related to the subscribed service).

4.2 Misuse or Excessive Use

Even on plans described as “unlimited”, you may not store unrelated media, bulk backups, third-party personal data, or any content unrelated to the subscribed service. “Unlimited” refers only to data necessary for your service to work properly (e.g., Minecraft worlds, plugins, and configs). In case of excess, we may notify, remove files, or temporarily suspend the service.

4.3 Maintenance & Availability

We aim to keep services online to the best of our ability, but—given the personal nature of this project— continuous availability or a minimum uptime is not guaranteed.

5.1 Prohibited Conduct & Content

• 2Hosting or distributing malware, viruses, phishing, or harmful software.
• 3Participating in DDoS attacks or activities affecting third parties.
• 4Cryptocurrency mining without express authorization.
• 5Pornographic or sexually explicit content.
• 6Content that promotes hate, violence, discrimination, or illegal activities.
• 7Infringing copyrights, trademarks, or software licenses.
• 8Hosting material that violates others’ privacy.

5.2 Penalties for Violations

• 3Reporting to competent authorities where applicable.

We reserve the right to assess each case individually.

6.1 Your Responsibilities

You are responsible for the content you host, your service configuration, and compliance with applicable laws in your country. MixelNodes is not liable for losses, damages, or interruptions caused by misuse or negligence.

6.2 Limitation of Liability

Services are provided “as is”, without express or implied warranties of continuous operation, performance, or full compatibility with third-party software. We are not liable for indirect damages, lost data or profits, downtime, or misuse by the customer.

6.3 Modifications & Maintenance

We may perform maintenance or changes at any time. Where feasible, we will provide notice, but we do not guarantee advance notice or specific maintenance windows.

7.1 Data We Process

We process basic account data (name, email), service metadata (plan, usage), and operational logs necessary for security and support. We do not store full payment instrument details.

7.2 How We Use Data

7.3 Data Sharing

You may request access, correction, or deletion of your personal data where applicable and technically feasible. Deleting data may affect service availability. Certain records may be retained for legal or operational reasons.

We may update these documents at any time. When material changes occur, we will make a reasonable effort to notify you (for example, via email or an in-app notice). Your continued use of the services after changes become effective constitutes acceptance of the updated terms.

9.2 Entire Agreement & Severability

These documents constitute the entire agreement between you and MixelNodes for the services described. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

9.3 Governing Approach

Given the personal and non-commercial nature of MixelNodes, we aim to resolve issues informally where possible. However, misuse, abuse, or harmful conduct will lead to swift action in line with these terms.
